THE PLANT
Hemp and marijuana are the same species, Cannabis sativa, separated only by law: in the US, hemp has no more than 0.3% delta-9-THC by dry weight, and anything above that is marijuana. “Hemp” and “marijuana” are not two species, they are legal categories drawn across one plant, Cannabis sativa, using a THC threshold. Understanding this clears up most confusion about legality and CBD.
Same plant, legal split
Botanically there is no hemp species. Hemp and marijuana are both Cannabis sativa. The distinction is defined by law, based on how much delta-9-THC the dried flower contains.
The threshold
In the United States the 2018 Farm Bill defines hemp as cannabis with no more than 0.3% delta-9-THC by dry weight; above that it is legally marijuana. The European Union uses a 0.3% field limit for approved industrial varieties (raised from 0.2% in 2023).
The exact number varies by jurisdiction, but the idea is universal: a THC ceiling separates the two.
What each is used for
Hemp is grown for fibre, seed, food and CBD extraction, and tends to be tall and low in THC. Marijuana-type cannabis is grown for THC-rich flower. Same genus, different breeding goals.

Cannabinoid synthase genetics and statutory dry-weight thresholds
Botanically, both industrial hemp and drug-type cannabis belong to a single polymorphic species, Cannabis sativa L., whose cannabinoid chemotype is governed by inheritance of functional THCA synthase and CBDA synthase alleles rather than leaf morphology (de Meijer et al., 2003, PubMed PMID 12582112; Jikomes & Zoorob, 2018, PubMed PMID 30096653). In statutory law, the distinction is defined strictly by dry-weight total delta-9-THC concentration, set at 0.3% under the United States Agriculture Improvement Act of 2018 (7 U.S.C. 1639o) and harmonized at 0.3% for European Union Common Agricultural Policy support from 2023 under Regulation (EU) 2021/2115.
Frequently asked questions about hemp vs marijuana
Are hemp and marijuana different plant species?
No. Both belong to the same botanical species, Cannabis sativa L.; they differ in how they were bred and in their dominant cannabinoid synthase enzymes (CBDA synthase in hemp vs THCA synthase in drug-type cannabis).
What is the legal THC limit for hemp in the US and EU?
Both the 2018 US Farm Bill and EU Regulation 2021/2115 (effective 2023 for CAP support) use a 0.3% delta-9-THC dry-weight threshold, though individual national rules on retail flower can still vary.
Can you tell hemp from marijuana just by looking at the plant?
Not reliably. While fiber hemp bred for stalks grows tall and sparse, modern CBD hemp grown for floral resin looks and smells virtually identical to high-THC cannabis and requires laboratory testing to distinguish.
